The Aussie Travel Saver and the agent agree to the following terms and conditions:
• All amounts are expressed in Australian dollars and include GST.
• The agent will offer the Aussie Travel Saver product at the agreed nominated value.
• Discounting of the Aussie Travel Saver product cannot exceed 30%.
• The agent will be entitled to total commission & discount allowance on selling price of 40% of the Aussie Travel Saver.
• The supplier will pay a further over-ride commission of 5% on all sales where the agent sales exceed 20 Aussie Travel Saver cards for the given calendar month on all sales for that month.
• The supplier will pay a further over-ride commission of 5% on all sales again for sales that equate to more than 50 in any monthly period.
• All payments are on the 15th day of every month following the sales of the Aussie Travel Saver. Such payment will be made by way of bank transfer to the nominated bank account of the agent.
1. The supplier will make available to the agent appropriate quantities of promotional material by way of brochures and similar type marketing materials where required.
2. The supplier will allocate the agent a unique agency code for sales tracking.
3. The unique agent’s code must be quoted for the agent to receive commission.
4. The customer of the agent will receive the nominated discount applied to the normal selling price when quoting the unique agent code.
5. For commission calculation purposes the normal selling price of the card applies i.e. $29 – 1mth, $49 – 3mths, $69 - 6mths and $98 – 12 mths, nett of discount allowed.
6. All orders of the Aussie Travel Saver will be made online by the customer of the agent through the Aussie Travel Saver website.
7. The supplier will deliver the Aussie Travel Saver discount card to the customers nominated delivery address after purchase and processing.
8. The supplier will keep the agent properly informed on an ongoing basis with updates regarding the Aussie Travel Saver product.
9. The agent will use its best endeavours to promote the Aussie Travel Saver and will observe the terms and conditions as they pertain to the Aussie Travel Saver as detailed under the heading “ Terms and Conditions” as detailed in the website www.aussietravelsaver.com.au.
10. Either party (Non – Defaulting Party) may terminate this agreement immediately by written notice to the other (Defaulting Party)
a. The Defaulting Party breaches a term of this agreement.
b. The Non-Defaulting Party gives the Defaulting Party written notice of such breach, specifying the action which needs to be taken to rectify the breach and allowing a reasonable time, which need not exceed 30 days, to remedy the breach; and
c. The defaulting Part fails to remedy the breach within the time specified in the written notice.
11. This agreement will be governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the Courts of Victoria and the Federal Court of Australia (Victorian division)
